Lindemann | 85 F.3d 1232 (7th Cir. 1996) Impeachment is a method of attacking a witness’s credibility so that the jury will lose confidence in the witness’s testimony. Rehabilitation is a method of repairing the witness’s credibility to make the testimony more believable. Rehabilitation is permitted only after impeachment. An attempt to enhance the witness’s credibility before impeachment is known as bolstering, and it’s generally not allowed. In United States versus Lindemann, we explore the difference between bolstering and rehabilitation. Wealthy equestrian George Lindemann, Junior, was accused of conspiring to have his horse, Charisma, killed for the purpose of collecting insurance proceeds. In connection with the conspiracy, Lindemann was tried for wire fraud in federal court. Tommy Burns, Charisma’s killer, testified that Lindemann was involved in the conspiracy. On cross examination, Lindemann suggested that Burns was lying about Lindemann’s participation in the conspiracy. Specifically, Lindemann posited that Burns couldn’t have gotten a plea deal without implicating a high profile coconspirator. On redirect examination, Burns testified that he had participated in many other similar conspiracies and had cooperated with the government’s prosecution of thirty other horse owners. Lindemann was convicted and appealed to the Seventh Circuit. On appeal, Lindemann argued that Burns’s testimony on redirect examination had been improper bolstering of Burns’s credibility.
