| Video Discription | Confederate General Robert E. Lee’s family had their Arlington Estate confiscated following a questionable and unethical property tax dispute during the Civil War. George Washington Parke Custis was the son of Martha Dandridge Custis Washington through her first marriage. When his natural father John Parke Custis died, George moved to his mother’s Mount Vernon residence where he resided with her and new husband George Washington. The couple raised him as their own son. Custis later began building the Arlington House on land that he had inherited from his natural father. The construction was completed in 1818. He intended the residence to become his home and a memorial to his foster father. He married Mary Lee Fitzhugh in 1804 and they had four children. Only one, Mary Anna Randolph Custis survived and would marry Robert E. Lee. Arlington House was given to Mary Lee in her father’s will with the stipulation that allowed her to live and operate the Arlington Estate for the rest of her life. She was not authorized to sell any portion of it. Upon Virginia seceding from the Union following the commencement of the Civil War, Robert E. Lee resigned his military commission on April 20, 1861. He would assume command of the armed forces of Virginia, later becoming commander of the Confederate Army of Northern Virginia. Arlington Estate was also the legal property of the military head of the opposition army. Depriving Lee of his residence became a popular rationale for possession. Mary Lee had sent an agent to pay the $92.07 property tax bill in a timely manner. The government turned away her agent refusing to accept her payment. The estate was foreclosed. The government acquired the property at a tax sale in 1864 for $26,000. Following the war’s conclusion in 1874, heir Curtis Lee would sue the United States claiming his ownership of the estate as stipulated in his grandfather’s will. On December 9, 1882, the U.S. Supreme Court ruled 5-4 in his favor determining that the Arlington Estate was confiscated without due process. _f1wsBxwQa4 |
