What makes this topic interesting is the challenge when identifying and classifying properties whether exclusive or conjugal/communal properties of the husband and the wife, while also integrating our discussion on topics involving the valuation of the properties to be included in the gross estate. As a rule, there are three regimes that we shall follow when classifying properties whether exclusive or conjugal/communal. 1. Marriage Settlement Agreement (Pre-Nuptial Agreement); 2. In the absence of the agreement, the following regimes shall apply: a. If the marriage took place before August 3, 1988, CONJUGAL PARTNERSHIP OF GAINS b.
